For the sake of simplicity, we refer to all of the above as our "services" in this data protection statement. To make it particularly clear, we have included links to these data protection provisions in all applicable services.
3. Information We Collect
It goes without saying that we cannot help you establish meaningful connections without knowing some information about you, such as basic profile information and the types of people you would like to meet. We also collect data that is generated while you are using our services, such as access logs, but also data from third parties, for example when you access our services via social media. Data you provide to us
When using our services, you decide to provide us with certain data. This includes:
When you create an account, please provide at least your login details and some basic details that are necessary for the execution of the respective service, such as your gender and your date of birth.
When you create your profile, you can provide further data, such as information about your personality, your lifestyle and your interests or other information about yourself, but also photos and videos. In order to add certain content such as photos or videos, you can allow us to access your camera and your photo album. Some of the information that you voluntarily provide may be considered "special" or "confidential" in some jurisdictions, such as information about your race or ethnicity, sexual orientation, or beliefs. By choosing to provide this information, you consent to the processing of this data by us.
If you register for a paid service or buy something directly from us (instead of using a platform such as iOS or Android), you provide us or our payment service provider with information such as your debit or credit card number or other financial data.
If you take part in surveys or target groups, let us know about your findings regarding our products and services, answer our questions and create testimonials.
If you decide to take part in our promotions, events or competitions, we collect the data that you use to register or participate.
If you contact our customer service, we will collect the information you provide to us during the interaction. Sometimes we monitor or record these interactions. This is done for training purposes and to ensure high quality services.
If you ask us to communicate with other people or otherwise process other people's data (for example, if you ask us to send an email to one of your friends on your behalf), we will collect the data that You make it available to us through other people to comply with your request.
Of course, as part of our services, we also process the chats you have with other people and the content you publish.
Information We Receive From Others

Other users Other users may provide us with information about you while they are using our services. We may collect information about you from other users when they contact us about you.
Social media You may be able to use your login data from social media (such as Facebook) to create your flockx account and to log into it. You don't have to remember any additional usernames and passwords and you can share some of the information on your social media account with us.
Other partners We may also receive information about you from our partners, for example when flockx advertisements are published on partner websites and platforms (in this case the partner may pass on information about the success of the campaign to us).
Information that is collected when you use our services
When you use our services, we collect information about which functions you have used, how you have used them and which devices you use to access our services. Further details can be found below:
Application information We collect information about your activity on our services, such as how you use them (e.g. the date and time you logged in, features you used, search queries, clicks and pages displayed to you referring website addresses, advertisements that you have clicked on) and how you interact with other users (e.g. users with whom you contact and interact, time and date of your interactions, number of messages you send and receive).
Device Information We collect information from and about the device (s) you use to access our services. Which includes:
Hardware and software information such as IP address, device ID and device type, device-specific settings and app settings and properties, application crash, advertising IDs (such as AAID from Google and IDFA from Apple. In both cases, this is the case randomly generated numbers that you can reset in the settings of your device), browser type, version and language, operating system, time zones and identifiers in connection with cookies or other technologies that can unequivocally identify your device or browser (e.g. IMEI / UDID and MAC address);
Information about your wireless and mobile network connection, such as your service provider and signal strength;
Information about device sensors such as accelerometers, gyroscopes, and compasses.
Other information with your consent If you allow us, we will record your exact geolocation (longitude and latitude) using different methods, depending on the services and devices you use, including GPS, Bluetooth or WiFi connection. The determination of your geolocation can take place in the background, even if you are not using the services, if the permission you have given us expressly allows such collection. If you don't allow us to determine your geolocation, we won't. We may also collect your photos and videos if you allow it (for example, if you want to publish a photo, video or streaming on the Services).
4. Cookies and comparable data collection technologies
Some web browsers (including Safari, Internet Explorer, Firefox, and Chrome) have a "Do Not Track" ("DNT") feature that notifies a website when a user does not want their online activity to be tracked. If a website that responds to a DNT signal receives a DNT signal, the browser can prevent this website from collecting certain data about the browser user. Not all browsers have a DNT option and DNT signals are not yet standardized. For this reason, many companies, including flockx, currently do not respond to DNT signals.

The main reason for using your data is to provide and improve our services. In addition, we use your data to protect you and to offer you the type of advertising that might interest you. 6. How we share your information
Since our goal is to help you establish meaningful connections, we primarily share user data with other users. However, we also share some user data with service providers and partners who help us perform our services and, in some cases, with judicial authorities. Read on to learn more about how your information is shared with others.
To other users
We share your data with other users if you voluntarily share information on our services (including your public profile). Please handle your data carefully and make sure that you only release content that is not unpleasant for you to publish, as neither you nor we can control what others do with your information once you have released it.
If you decide to limit the target group for all or part of your profile or for certain content or information about you, these will be visible according to your settings.
To our service providers and partners
We work with third parties to run and improve our services. These third parties assist us with a wide variety of tasks, including data hosting and maintenance, customer support, marketing, advertising, payment processing and security operations.
We are also allowed to pass on your data to partners who support us in the distribution and marketing of our services. For example, we may pass on limited information about you to advertising partners in a hashed form that cannot be read by humans.
Before we hire a service provider or work with any partner, we go through a rigorous review process. All of our service providers and partners must agree to strict confidentiality obligations.
In corporate transactions
If we are wholly or partially involved in a merger, sale, acquisition, disposal, restructuring, reorganization, dissolution, insolvency or other change of ownership or control, we may also pass on your data.
If required by law
We may disclose your information if it is reasonably necessary: (i) to comply with a legal process, such as a court order, subpoena or search warrant, an official / criminal investigation or other legal requirements; (ii) to assist in crime prevention or investigation (in any case in accordance with applicable law); or (iii) to protect the safety of another person.
To enforce legal rights
We may also disclose information: (i) if disclosure would reduce our liability in an actual or threatened legal action; (ii) if this is necessary to protect our legal rights and the legal rights of our users, business partners or other interested parties; (iii) to implement our agreement with you; and (iv) to investigate, prevent, or take other action against illegal activity, suspected fraud or other misconduct.
With your consent or at your request
We may ask for your consent to your data being passed on to third parties. In such a case, we will make it clear why we want to pass on the data.
Under any of the above circumstances, we are permitted to use non-personal data (data that alone are not sufficient to identify you as a person, such as device information, general demographic information, general behavioral data, geolocation in anonymous form), but also personal data in hashed in a form that cannot be read by humans, use and pass on. We may also share this information with third parties (especially advertisers) in order to develop and deliver targeted advertisements on our services, and to analyze and report on advertisements you see. We may combine this information with other non-personal information or personal data in hashed, human-unreadable form that was collected from other sources.
7. Cross-border data transfer
The transfer of data sometimes involves transferring data across borders, for example to the United States and other jurisdictions. For example, if a service allows users to be located in the European Economic Area (“EEA”), their personal data will be transferred to countries outside the EEA. We use standard contractual clauses approved by the European Commission or other reasonable security clauses to allow data transfer from the EEA to other countries. Standard contractual clauses are binding obligations to protect the privacy and security of your data between companies that transfer personal data.
8. Your rights
We want you to be able to control your data, so we provide you with the following tools:
Access / update tools in the services. Tools and account settings that help you access, correct or delete information that you have provided to us and that is directly related to your account within the respective service. If you have any questions about these tools and settings, please contact us.
Device permissions. Mobile platforms have authorization systems for specific types of device data and notifications, such as telephone book and location services or push notifications. You can change your settings on your device to either agree or decline the collection of related information or display of related notifications. Of course, if you do this, certain services may no longer be fully functional.
Deletion. You can delete your account by using the associated function directly in the respective service.
We want you to be aware of your data protection rights. Here are some key points to keep in mind:
Update your data. If you are of the opinion that the data we have stored about you is incorrect or that we no longer have the right to use this data and would like to request its correction or deletion or object to its processing, please contact us.
For your protection and the protection of all of our users, we may ask you to provide proof of identity before we can process the above requests.
Please note that we may reject applications for certain reasons, for example if the application is illegal or violates trade secrets, property rights or the privacy of another user. If you would like to receive information in connection with another user, such as a copy of the messages you have received from him or her, the other user must contact our Privacy Officer and give his / her written consent before we can release this information .
In addition, it may be the case that we are unable to comply with certain requests to revoke the processing of personal data, especially if this would prevent us from providing our services to you. For example, we cannot offer you any services if we do not know your date of birth.
Uninstall. You can stop an app from collecting all information by uninstalling it using the standard uninstallation process on your device. If you uninstall the respective app on your mobile device, the unique identifier of your device will still be saved. If you reinstall the application on the same device, we can re-associate this identifier with your previous transactions and activities.
Accountability. In some countries, including the European Union, you have the right to lodge a complaint with the relevant data protection authority if you have concerns about our processing of your personal data. The data protection authority to which you can lodge a complaint may be that of your habitual residence, place of work or a jurisdiction in which we are located.
9. California resident
If you are a California resident, you can request a notice detailing the categories of your personal information that we shared with third parties for marketing purposes during the previous year. To request this notification, please submit your application. Please give us 30 days to process. For your protection and for the protection of all our users, we may ask you to provide proof of identity before we can process such requests.
10. How we protect your data
We make every effort to protect your personal data from unauthorized access, alteration, disclosure or destruction. While we take steps to protect your information, like all technology companies, we do not promise that your personal information will always be kept secure, nor should you expect it to be.
We regularly check our systems for possible weaknesses and attacks and regularly review our methods for collecting, storing and processing data in order to update our physical, technical and organizational security measures.
We may suspend your use of some or all of our services without notice if we suspect or discover any security breach. If you think your account or your details are no longer secure, please let us know immediately.
11. How long we keep your data
We only keep your personal information for as long as we need it for legitimate business purposes and as permitted by applicable law. In order to ensure the protection and security of our users inside and outside our services, we keep your data for three months after deletion of the account. During this time, the account data will be saved, although the account will of course no longer be visible to anyone.
In practice, this means that after your account has been deleted (and the security retention period has expired) or after two years of continuous inactivity, we will delete or anonymize all of your data, unless:
we are required by applicable laws to store it (for example, some “traffic data” is stored for one year in order to comply with statutory retention requirements);
there is an open question, lawsuit or dispute that causes us to retain material information until the issue is resolved; or
the data must be retained for legitimate business interests such as fraud prevention and enhancing user security. For example, data is stored to prevent a user who has been blocked due to unsafe behavior or security incidents from opening a new account.
Please note that due to technical restrictions we cannot promise that all data will be deleted within a certain period of time, even if our systems are designed in such a way that they carry out data deletion procedures in accordance with the guidelines mentioned above.
12. Children's privacy
Our services are limited to users who are at least 18 years old. We do not allow users under the age of 18 on our platform and we do not knowingly collect any data from minors. If you suspect that a user is a minor, please report this using the reporting mechanism available on our service.
